How & Why Illinois Wine Laws Must Be Changed.
1. Consumer access to legitimate and legal products is the foundation for vibrant, market expanding free enterprise. By unreasonably cutting off consumer access to 1000s of wines by prohibiting Illinois consumers from having wine shipped to them from out-of-state retailers, lawmakers have spoiled free enterprise in Illinois and denied consumers access to a legitimate market for wine.
2. Illinois Residents are being denied access to millions of dollars in tax revenue. By not allowing consumers to buy wine from out-of-state retailers and taxing it exactly as they tax sales by out-of-state wineries and in-state wine stores, the state and its residents lose access to millions of dollars otherwise available to use for civic and social good.
3. Direct shipment of wine to Illinois consumers by out-of-state wine stores poses no additional threat to minors. Minors, if they want to obtain wine via direct shipment, can do so just as easily from in-state wine stores, in-state wineries and out-of-state wineries, all of whom the state allows to ship wine direct to consumers.
4. Prohibiting Illinois Consumers from buying wine from out-of-state wine stores appears only to benefit special interests that give large contributions to politicians. Only in-state wine stores and Illinois alcohol distributors benefit from shutting down this channel of commerce. Millions of dollars in campaign contributions should not justify denying access to wine by adult Illinois wine consumers.
THE ILLINOIS WINE CONSUMER COALITION CALLS ON THE ILLINOIS LEGISLATURE TO AMEND ITS WINE LAWS THAT ARE AN AFFRONT TO FREE TRADE, COMMERCE, ILLINOIS CONSUMERS, REASON, FAIRNESS, THE U.S. CONSTITUTION AND GOOD GOVERNMENT BY ENACTING A LAW THAT DOES THE FOLLOWING:
- Creates a permit issued by the Illinois Liquor Control Commission that out-of-state retailers may obtain allowing them to sell and ship wine to Illinoisans the same way out-of-state wineries may obtain such a permit
- Charges an annual fee for wine retailer shipping permit
- Provides for and requires the collection of taxes from permit holders on all wine shipped into the state by out-of-state retailers
- Requires out-of-state retailers to file reports on the amount of wine shipped into Illinois
- Requires all wine shipments by out-of-state retailers to carry a sticker alerting the delivery driver that the package contains alcohol
- Provides that retail wine shipping permit holders are subject to Illinois legal jurisdiction if they break Illinois law.
THE IWCC URGES ALL ILLINOIS CONSUMERS TO CONTACT THEIR LEGISLATORS AND DEMAND THEY TAKE ACTION TO ALLOW ILLINOIS CONSUMERS TO ONCE AGAIN HAVE TRUE ACCESS TO WINE.
